Sheridans Wins Pink Floyd Digital Royalties Court Battle
with EMI

As leading music industry publication, Music Week reports:-

"Pink Floyd have won their digital royalties High Court action against their record company EMI.

The dispute was over how digital royalties were calculated and if EMI had the right to unbundle their albums and sell them online on a track-by-track basis.

The BBC has reported that EMI has been ordered to make an interim payment of £40,000 in court costs. How much the record company will have to pay in total to the band has yet to be decided.

The lawsuit was originally filed in April 2009 and the case began in the High Court in London on Monday. Many copyright experts were expecting the case to last several weeks, if not months.

At the heart of the dispute was the definition of “record” and if unbundling only applied to physical formats.

The band last renegotiated their contract with EMI, the label they originally signed to in 1967, back in 1999 in a time before mainstream adoption of digital downloading.

EMI is currently unavailable for comment."
